Gifting a mobile home to family, putting a son or daughter on the title, adding a new spouse, or taking an ex-spouse off after a divorce — each is an HCD transfer with its own forms and signatures. Come to our San Jose office and we prepare the packet so it is accepted the first time. $325.

How it works — in person or by phone

  1. Call (408) 766-3532 or come by our San Jose office. Tell us what happened and whose name is going on or coming off.
  2. Bring the title, the registration card and the decal number. We go through them with you and fill out every HCD form — no computer needed.
  3. We request the tax clearance from the Santa Clara County Department of Tax and Collections — you collect it and pay the county directly.
  4. You sign at our office with our notary on site, and leave with a packet ready to mail to HCD with your check. Every owner printed on the title signs.

Our part takes one to two business days. $325 for the preparation; HCD’s fees, the county’s tax clearance charge, and any use tax are paid by you to those agencies at cost. Rather do it from home? Start online in about ten minutes, with no payment to start.

What are you changing?

Every person printed on the current title has to sign, unless a court order or death certificate takes their place.

Add a name

Add an adult child or relative

The current owners sign the title over to themselves and the new co-owner. HCD’s family transfer forms document that there was no sale.

Add a name

Add a new spouse

The same transfer, with both spouses printed on the new title the way you choose to hold it.

Remove a name

Take an ex-spouse off after a divorce

Either the ex-spouse signs off, or you attach a certified copy of the judgment or marital settlement agreement that awards you the home.

Remove a name

A co-owner agrees to come off

Every owner printed on the title signs, and the new title is issued without the departing owner.

Remove a name

A co-owner has died

That is a different HCD form set, filed with a certified death certificate. See mobile home transfer after a death.

How the names will read

This choice matters later, especially when a parent adds a child. Here is what each option generally means.

Joint tenants

If one owner dies, the other owns the whole home without an heir transfer.

Tenants in common

Each owner has a share that passes to their own heirs when they die.

Community property

Available to married couples and registered domestic partners.

You decide

We print the title exactly as you instruct. If you are unsure which to choose, ask an attorney or tax advisor before you sign.

Before you add someone

If the person you are adding will live in the home, the park may require them to apply as a resident. That approval is separate from the HCD title. Adding a name gives that person a real ownership share, and from then on their signature is needed to sell or refinance.

Doing it yourself vs. having it prepared

HCD publishes its forms free, and some people do file their own. Many of the calls we get come from people whose packet came back. Here is where the time goes.

Questions people ask before starting

How do I add my son or daughter to my mobile home title?
The current owners sign the title over to themselves and your son or daughter on HCD’s family transfer forms, with a tax clearance from the county. You choose how the names will read, such as joint tenants or tenants in common, and HCD issues a new title. We prepare the packet at our San Jose office for $325.
Can I gift my mobile home to my son or daughter?
Yes. Gifting a mobile home to family is a no-sale transfer on HCD’s family transfer forms. You can sign the whole home over, or add your child and stay on the title yourself. Every owner on the current title signs, the county tax clearance is attached, and HCD issues the new title. Ask a tax advisor about gift tax reporting before you sign.
How do I remove my ex-spouse from a mobile home title?
Either your ex-spouse signs the release on the title, or you attach a certified copy of the divorce judgment or marital settlement agreement awarding you the home. We prepare the HCD forms around whichever you have.
Can I remove someone from the title without their signature?
Not with HCD forms alone. You need their signature, a court order, or, if they have died, a certified death certificate with HCD’s deceased co-owner forms.
Is adding a name to a mobile home title a sale?
No. A family transfer is a no-sale transfer, and the HCD forms record that. Use tax is generally tied to a sale.
Can we all come to your office to sign?
Yes. Everyone on the title can sign together at 434 Blossom Hill Rd, San Jose, with our notary on site. Call (408) 766-3532 to set a time.
Does the park have to approve the person I add?
If that person will live in the home, the park may require a resident application. That is separate from the HCD title.
How much does it cost to add or remove a name?
Our preparation fee is $325. HCD’s fees and the county’s tax clearance charge are paid separately to those agencies.
How do I sign over my mobile home title to someone?
Every owner printed on the title signs the release on the original title exactly as their name appears, and the matching HCD transfer form is signed with it. One missing or mismatched signature sends the packet back, so we show each person exactly where to sign before anything is mailed.
