Revocable or Irrevocable Trust: What Is the Difference?

The word trust covers two very different tools. A revocable living trust, the kind most families use to avoid probate, can be changed or undone at any time. An irrevocable trust generally cannot, and that permanence is the entire point of it. Confusing the two, or reaching for the wrong one, leads to either lost flexibility or lost protection.

The revocable trust: control and flexibility

A revocable living trust keeps you in full control. You can amend it, move assets in and out, or revoke it entirely while you are alive. Its job is to avoid probate and manage your assets if you become incapacitated, without giving anything up. This is what most people mean by a living trust.

The irrevocable trust: protection through permanence

An irrevocable trust generally cannot be changed or undone once created, and you give up control of the assets placed in it. In exchange, it can offer protections a revocable trust cannot, such as certain asset protection or tax planning. The tradeoff is real and permanent.

Why the tradeoff cuts both ways

Choosing revocable means keeping control but forgoing the specialized protections of an irrevocable trust. Choosing irrevocable means gaining those protections but surrendering control. Neither is better in the abstract; they answer different questions, and the wrong choice is expensive to reverse.

Why most families start revocable

For the common goal of avoiding probate and keeping a home in the family, the revocable living trust is usually the fit, because it does the job without giving up control. Irrevocable trusts serve narrower, more advanced purposes, and deciding you need one is a conversation for a licensed professional.

Why is a signed trust not always enough?

The costliest trust problems are rarely typos. They happen when the home never gets deeded into the trust, when accounts stay outside it, or when the trust, the will, and the beneficiary designations contradict each other. Those gaps stay hidden until the family needs the plan to work.

Frequently asked questions

What is the difference between a revocable and irrevocable trust?

A revocable trust can be changed or undone during your life and keeps you in control. An irrevocable trust generally cannot be changed, and you give up control in exchange for protections it can offer.

Which trust avoids probate?

Both can, but the revocable living trust is the common tool for probate avoidance because it does the job without giving up control of your assets.

Can I change an irrevocable trust later?

Generally no. Permanence is the point of an irrevocable trust, which is why it is used for specific protection and tax goals rather than everyday planning.

Which trust do most families need?

For avoiding probate and keeping a home in the family, most start with a revocable living trust. Irrevocable trusts serve narrower, advanced purposes.

Can a Legal Document Assistant prepare either trust?

An LDA can prepare a trust at your direction once you decide which you need. Whether an irrevocable trust fits your goals is legal advice for a licensed attorney.
